With this Privacy Policy we would like to inform you about how we process personal data and what information is collected when you use our services.

We are aware of the importance of the processing of personal data for the user and accordingly comply with all relevant legal requirements. The protection of your privacy is of utmost importance to us. Please read the entire data protection declaration to fully understand our actions.

Glossary

In this Privacy Policy, the following terms may appear, which are defined in more detail below.

 

  • Computer
    Any devices that allow access to digital content. Included herein: Desktop Computers, laptops, tablets, mobile phones or other connected devices.
  • Dashboard
    Our Dashboard, which Online-Merchants as our confidential partners can access. Included in the Dashboard monitor are analysis and assessment tools to improve their offering. In addition, Online-Merchants can access user information via the Dashboard (see "Uses").
  • Domain
    The unique Internet address of a website.
  • Online-Merchant / Online-Shop
    A confidential entity that has authorization and access to the FRAEND GmbH service and uses it according to our regulations.
  • Personal Data ("PII")
    All information about personal and factual circumstances of a specific or identifiable person. This includes information and data such as your name, your address or other postal details, the telephone number or your e-mail address.
  • Service
    Access to and use of our rating / messenger and dashboard solution.
  • Tool
    The digitally provided rating / messenger solutions that run through the Embed Script Codes, hosted by us, on an Online-Merchant's website.
  • User
    Any end User using our Services.

 

How We Receive Information

We receive information (including possibly personal information) from different sources:

  • If you voluntarily provide us your personal details within our Services (for example by registering, using your business account access in our Dashboard or by subscribing to our newsletter);
  • If you visit the fraend.com homepage or by using our Dashboards;
  • From third party websites and services where our Tools are embedded (i.e. we may receive information from Online-Merchants, who have our Tools embedded in their Online-Shops).

 

Uses

FRAEND GmbH offers a Service by means of which Users can rate products in Online-Shops and subsequently enter into a direct interaction with other active Users. Our Service automatically stores a Cookie on the user's Computer, which allows us to summarize rating results in a statistically effective way and to optimize our service and the information displayed for the User's benefit. This Cookie is based on a randomized online identifier.

The additional data collected includes the category of the content of the visited website, the type of FRAEND Tool that was used, the language of the content, browser, operating system, device type, location information and whether you submit a rating or click or interact with any other content. This information is combined with the identifier to form a user profile. The user profile does not contain any names, postal addresses, telephone numbers, e-mail addresses or similar personal data.

The data collected will be used, among other things, for the following purposes:

  • To generate, display and share relevant aggregates (without any reference to personal information) from our product ratings with our partners.
  • To recommend products, services or other relevant services.
  • To improve our offering.
  • To protect against abuse.
  • For statistical evaluation.

Statistical information helps to understand trends and customer needs so that they can be taken into account in new products and Services as well as to improve existing products and Services.

In addition, we only collect personal data to the extent and for the purpose for which you voluntarily provide us with the data, i.e. as part of a registration. This information may be added to an existing User profile (see "Uses" paragraphs 1 & 2) or compiled into a new User profile. The User profile may contain names, postal addresses, telephone numbers, e-mail addresses or similar personal data. Examples include marketing communications, requests from you, or information we collect from you to enter into a joint business relationship.

If user information or user profiles were collected by registering or using Tools in the Online-Shops of our confidential partners, they can theoretically also track your FRAEND usage and, if necessary, use User profiles for marketing communication.

Legal Basis of Data Processing

Our legal basis for the collection and use of the personal data described in this Privacy Policy depends on the personal data concerned and the specific context in which we collect it.

Basically, the data processing takes place on the following legal bases:

  • With regard to data that you specify in forms, etc., with your consent, Art. 6 para. 1 lit. a) GDPR
  • In relation to the services you use to carry out a contract with you, Art. 6 (1) lit. b) GDPR
  • For the rest, in particular for statistical data and online identifiers, on the basis of legitimate interests, Art. 6 para. 1 lit. f) GDPR

When we collect and use your personal information for legitimate interests (or that of a third party), that interest is usually in the provision of our Services and our commercial interests. For example, answering your inquiries, improving our Tools and Services, marketing or preventing illegal activity. We may have other legitimate interests and, if appropriate, we will make it clear to you at the relevant time within the Tool which legitimate interests they are.

 

Data Security Measurements

We have taken extensive technical and organizational measures to safeguard your information against possible risks, such as unauthorized access, unauthorized modification or dissemination, loss, destruction or misuse. The complete measures can be found here: https://safety.fraend.com/.

Actions include, but are not limited to, the safekeeping of your data in secure, firewall-protected, and through other means secured servers running at certified facilities. Strict internal guidelines determine who has access to and what volume of data within FRAEND GmbH. In addition, it is ensured that only employees of FRAEND GmbH and our confidential partners have access to your personal data and we work continuously to improve our security standards if suitable new technologies are available.

In order to protect your personal data from unauthorized third-party access during transmission, we secure the data transmissions using SSL encryption if necessary. It is a standardized encryption method for online services, especially for the Web.

While we perform the steps outlined above to ensure that your data is safe in our system, data transmission over the Internet can not be guaranteed to be 100% secure. For that reason, we cannot guarantee the security of the information you provide to us. You do this at your own risk.

 

Your Rights

  • You have the right to request information as to whether and which personal data we process through you. You also have the right to request the correction of your personal data or its completion.
  • In certain circumstances, you have the right to request that your personal information be deleted.
  • In certain circumstances, you have the right to request that the processing of your personal data be restricted.
  • You may withdraw your consent to the processing and use of your data in whole or in part at any time with future effect.
  • You have the right to receive your personal information in a standard, structured and machine-readable format.
  • If you have any questions, comments or complaints or requests for information in connection with our Privacy Policy and the processing of your personal data, you can contact our data protection officer in writing.
  • You also have the right to lodge a complaint with the relevant regulatory authority if you believe that the processing of your personal data violates the law.

We respond to any requests we receive from individuals wishing to exercise their privacy rights in accordance with applicable privacy laws.

 

Storage Time

We store your data,

  • if you have consented to the processing at most until you revoke your consent
  • if we need the data to execute a contract, at most as long as the contractual relationship with you or statutory retention periods are in effect,
  • if we use the data on the basis of a legitimate interest, at most as long as your interest in deletion or anonymization does not prevail. All PII that we collect from you will be processed after a period of one year in such a way that the personal connection to an original person can no longer be established.

 

Requirement or Obligation to Provide Data

Unless specifically stated during the collection, the providing of data is not necessary or obligatory.

 

Cookies

Cookies are small files that your browser places on your device in a designated directory. These Cookies can be used to determine, for example, whether you have visited a website before. Most browsers accept Cookies automatically. However, you can set your browser so that no Cookies are stored or an explicit consent is required before saving a Cookie. Depending on the Service, we store the following Cookies under the Domain fraend.com:

  • FRAEND Opt Out Cookie ("_fr_optout")
    This Cookie informs the FRAEND Service that a User opted out and thus no further data is processed or stored.
  • FRAEND User Cookie ("u", "fpd")
    This Cookie contains a randomized identifier, by means of which FRAEND GmbH can combine the surfing behavior of a User into a User profile.
  • FRAEND Vote ("_fraend_vote")
    This Cookie indicates whether a User has already rated a specific product.
  • FRAEND Messenger Authentication ("m_auth")
    This Cookie is set only for Users of our messenger and allows the user to identify themselves as authenticated. Without this Cookie, a User of the messenger would have to log in before use or each step.
  • FRAEND Dashboard Authentication ("d_auth")
    This Cookie is set only for Users of our Dashboard and allows the user to identify themselves as authenticated. Without this Cookie, a User of the Dashboard would have to log in before use or each step.
  • Google cookies (ie "_ga", "_gat UA", "__utma", "__utmz")
    These Cookies are set by our service provider Google Analytics and give the FRAEND GmbH the opportunity to analyze the surfing behavior of Users. Google’s privacy policy can be found here: www.google.com/privacy.html

 

Data Partnerships

We also use data provided by our partners and third parties to supplement the User profiles of FRAEND GmbH, thereby improving our results and making them more informative.

FRAEND GmbH makes reasonable efforts to ensure that all its service providers are subject to confidentiality and non-use obligations and are required to process personal information in accordance with the applicable laws only in accordance with FRAEND GmbH’s instructions in a separate data processing agreement.

 

Usage-Related Advertising

The advertising displayed by the Services of FRAEND GmbH is partly optimized for you by the anonymous collection and processing of your usage behaviour, so that you are shown advertising tailored to your interests. A Cookie is stored on your Computer for this purpose. Behavourial targeting and retargeting is carried out by third-party companies that also advertise websites of other providers. These third-party companies then create the aforementioned User profiles themselves using Cookies and use their respective targeting systems to select the collected data for the purpose of User-oriented advertising.

With the Dashboard the FRAEND GmbH provides a Service, through which Online-Merchants can carry out direct remarketing of their website visitors. Online-Merchants can use the Dashboard to analyze user information (see "Uses") and to optimize some of their marketing and communication offers for you.

 

Web Analytics

Like almost every website operator, we use tracking software analysis tools to determine the frequency and number of Users on our website.

In order to optimize this website and our Services, we use Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "Cookies", text files that are stored on your Computer and enable an analysis of your use of the website. The information generated by the Cookie about your use of this website (including your IP address) will be transmitted to a Google server in the USA and stored there. However, if you enable IP anonymization on this website, your Google IP address will be truncated beforehand within Member States of the European Union or in other signatory states to the EEA Agreement. Only in exceptional cases is the full IP address transferred to a Google server in the USA and truncated there. We use Google AdWords Remarketing to advertise FRAEND across the Internet. AdWords remarketing will display relevant ads tailored to you based on what parts of the FRAEND website you have viewed by placing a Cookie on your machine. This Cookie does not in anyway identify you or give access to your computer. The Cookie is used to say “This person visited this page, so show them ads relating to that page.” Google AdWords Remarketing allows us to tailor our marketing to better suit your needs and only display ads that are relevant to you.

Logfiles

Every time you access our Internet pages, usage data is transmitted through the respective Internet browser and stored in log files, the so-called server log files. The records stored in this case contain the following data:

  • Domain from which the User accesses the website
  • Date and time of retrieval
  • IP address of the accessing Computer
  • Website(s) that the User visits as part of the offering
  • Transmitted amount of data, browser type and version
  • Operating system used and Name of the Internet service provider
  • Message if the retrieval was successful

These logfile records are evaluated anonymously to improve the offering and make it more User-friendly, to find and fix bugs, and to control server load.

Data Transmission to Third Countries

Data may be transferred to third countries outside the European Union. This is done on the basis of legally provided contractual arrangements, which should ensure an adequate protection of your data.

FRAEND may refer to the website of third parties that provide useful information / services. All information that the user makes available on the linked pages is passed on directly to these third-party providers and is subject to the privacy policy of the respective provider. FRAEND is not responsible for the content or privacy practices of websites it links to. Links from FRAEND’s Service to third parties or other websites are provided for the convenience of the User. You should consult the privacy policies of each website before providing them with personal information.

 

Facebook

Facebook is operated by Facebook Inc. of 1601 S. California Ave, Palo Alto, CA 94304, USA and is available at www.facebook.com. These individual social plugins are identified by one of the Facebook logos or with the addition "Facebook Social Plugin". A list of the appearance and functions of each plugin can be found here: developers.facebook.com/docs/plugins. When you access a page of our website that contains such a social plugin, the browser you are using will establish a direct connection to Facebook’s servers. The content of the social plugin is sent directly from Facebook to your browser and integrated into the website by your browser. We have no control over the amount of data that Facebook collects using the social plugins, and therefore we would like to inform you about this to the best of our knowledge: Due to the inclusion of the social plugins, Facebook will be informed that you have visited the corresponding page of our website, even if you are not registered as a Facebook user or not logged in to Facebook.
